CALIFORNIA REAL ESTATE BROKERS, AGENTS AND FUTURE LICENSEES UNLAWFUL DISCIPLINARY ACTION PROTECTION, PREVENTION & PROHIBITION.
In 2006 the Department of Real Estate Commissioner adopted an Administrative Law Judge's decision to REVOKE MY LICENSE, WITHOUT THE RIGHT TO A RESTRICTED LICENSE, based on an accusation of a drinking and driving conviction that was NOT a crime involving moral turpitude. This decision to revoke my license was made 3 years after my conviction... that's right, 3 years. Oh and I was convicted of a "Wet Wreckless" not even a DUI!
I do not need a law degree to know my rights. I study the law, business & professions code and court cases often because I feel that knowledge is power. I knew that the DRE was in the wrong and I was not about to let the DRE take my livelihood away without a fight. Thus far, the fight for my rights and your rights is far from over. I am determined, I am dedicated and I am passionate - I will not give up.
The DRE broke the laws they wrote, abused the power given to them and overstepped their boundaries. I think they feel they can get away with such behavior because they have the money from the recovery account to do so. It's not like Jeff Davi's pockets are emptied every time an administrative hearing takes place!
Depending on the circumstances, an administrative hearing can take more than one year before a final decision is made. The case can go on for years if a licensee appeals that decision. Most agents do not have the time and cannot afford to fight the DRE. Not everyone has $10,000 just laying around collecting dust...
Finally, after 10 months and tens of thousand of dollars spent, I prevailed. I got my license back and the entire case thrown out. Talk about a waste of time and money. Winning my case didn't come without me losing.

I have the names of licensees the DRE unlawfully disciplined since 2003. The sad thing is that these licensees have no idea that they can get their license back & the negative marks removed from their public DRE record. I plan to work hard to restore their licenses and to protect all California licensees.
I do not want another agent or broker to go through what I went through. I do not want the DRE to get away with unlawfully taking away the livelihood of real estate licensees.
I do not want a family or individual to lose their home, income, hopes, security, health, insurance or living needs. I do not want another person to feel powerless, useless, unheard, wrongfully accused, shamed or unworthy.
California Real Estate Agents and Brokers are passionate, dedicated, giving and caring individuals. We take pride in our work and we value our clients. Losing a career we are deeply committed to is devastating. We can't just go get a job in the same field at a different company - it just doesn't work that way. For most California Real Estate Agents and Brokers, their license is their life and it defines who they are.
Do not let the DRE define you as being someone you are not.
